Terms of service

1. Acceptance

By creating a gochron account or using the service, you agree to these terms on behalf of yourself and, if applicable, the organization you represent. If you do not agree, do not use the service.

2. The service

gochron provides cron heartbeat monitoring, uptime probes for HTTP, TCP, and SSL endpoints, on call rotation and escalation, and hosted status pages. Features and limits depend on your chosen plan.

We may modify, improve, or discontinue features. Material removal of a feature you depend on will be announced at least 60 days before it ships, with reasonable accommodation for migration.

3. Accounts

You are responsible for the security of your account credentials. Magic link sign in uses email as the verification mechanism, so anyone with access to your inbox can sign in. Keep your inbox secure.

API tokens grant the same access as your account. Treat them as passwords and rotate them if exposed.

One person may not register more than one Free tier account to evade quota limits.

4. Acceptable use

You agree not to:

  • Probe systems you do not own or have explicit permission to probe.
  • Use the service to launch or coordinate denial of service attacks.
  • Bypass rate limits or quota mechanisms.
  • Reverse engineer the service for the purpose of building a competing product.
  • Resell access to the service without a written agreement.
  • Upload content that infringes intellectual property rights or violates law.

We may suspend accounts that violate these rules. For clear abuse (probing third parties, attack participation) we may suspend without notice.

5. Plans, fees, and billing

Free tier is permanent and does not require a payment method. Paid tiers are billed monthly in advance via Stripe. Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing period.

SMS usage above the included monthly quota is billed at cost plus a small margin. Overage is shown on the invoice for the period in which it occurred.

If a charge fails we will retry over 7 days and email you about it. Sustained payment failure may result in account suspension. Reactivation requires settlement of the outstanding balance.

Refunds for accidental upgrades or duplicate charges are available within 30 days of the charge. Email [email protected].

6. Customer data

You retain ownership of the data you submit to the service: monitor configurations, probe results, ping history, alert destinations, and so on. You grant us a limited license to host, process, and display that data solely for the purpose of providing the service.

7. Service availability

We target 99.99 percent monthly uptime on the API and ingest path. Status pages target the same independently. Scheduled maintenance is announced in advance and excluded from these targets.

If we fall below these targets in a billing month and the shortfall is not due to factors outside our control (network issues at a sub processor, force majeure), you may request account credit on a sliding scale up to one month of fees. Credit requests must be filed within 30 days of the affected month.

8. Confidentiality

We will treat the technical details of your infrastructure (URLs, endpoints, schedules, on call rosters) as confidential and will not share them outside the scope necessary to run the service.

9. Termination

You may close your account at any time from the dashboard. We may terminate accounts for unpaid fees after notice, or immediately for breach of the acceptable use policy.

On termination we delete account data within 30 days. Invoices and tax records are retained per applicable law (typically up to 7 years).

10. Warranties and disclaimers

The service is provided “as is”. We do not warrant that the service will be uninterrupted, error free, or fit for any particular purpose beyond what is described in our marketing.

gochron is one part of your reliability stack. If a probe misses an outage or a heartbeat alert is delayed, the loss is limited to what these terms say.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim arising from these terms is capped at the fees you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold gochron harmless from claims arising out of your use of the service in violation of these terms or applicable law, including third party probing without permission.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Disputes will be heard in the state and federal courts located in Delaware.

14. Changes to these terms

When we change these terms in a way that affects your rights we will notify you by email at least 30 days before the change takes effect. Continued use of the service after that date is acceptance of the new terms.
